When your phone rings and there is someone on the other end telling you you have a debt that needs to be paid that you know is over 6 years old or was included in a Bankruptcy years ago.....
Don't fall for it!. If you filed bankruptcy on the debt, send a copy of your bankruptcy schedules along with your discharge via certified mail to the Collection Agency.

If a Collection Agency calls or you get a summons on a debt that is 3- 6 years old, do not do anything until you find out what your rights are. Each State has a Statue of Limitations in place that
determinds the length of time a debt can be collected on by a debt collector. You can find out what the Statue of Limitations are in your state by going to the Secretary of States web site for the State you reside in. Or Click Here for a list of most states.
After you determan the Statue for your state, send a copy of the Statue along with a letter to the Collection stating that they quit contacting you. Send via Certified Mail. |
